The following is the account of a good friend of mine who was arrested for not paying a traffic ticket in LA county.

I was arrested for not paying a traffic ticket. (failure to appear). I was taken to LA county jail and booked into the system.

As I was only 19 and this being my first invitation into County jail, I was unprepared for the events of the next 72 hours.

My main fear on the ride to the jail was all the stories I had heard about other inmates raping and assaulting people, so I was naturally a little on edge about that.

What really blew my mind was how harshly the staff treated all the inmates that were booked that day.

For one thing, the sheriff deputies would bark out quick orders and if you did not decipher their lingo quickly, it was cause to be singled out.

A black inmate fell victim to this first and was taken away for not following the instructions and we overheard him being beaten. I was appalled to overhear other deputies asking in our earshot "So did you beat anyone today?"

No sooner did I hear this when I was asked by a deputy to stand on the yellow line to have my picture taken.

As requested I stood on the yellow line and in a mere seconds I felt a stiffed armed palm crash into my shoulder. The force of the blow spun me around.

I looked at the officer so as to question what made him act that way and the officer said. "I said stand on the yellow line, you were standing over the yellow line.

Now I was not happy about what was clearly a violation of my rights and I wanted the officer to know this would not be the last word so (like a fool) I glared at the officer while I was on line.

After my pictures, 3 officers (including the one that assaulted me) took me into a back room jail and threw me against the wall. One officer kicked me in the groin area and another choked me.

I was really scared at this point as I now believed for the first time they could kill me and nobody would know how it happened.

I had a $5 bill that came out of my jumpsuit during the scuffle and one of the officers took it and put it into his pocket and laughed as they all left.

Thinking there would be swift retribution against these rogue cops, I immediately filed a complaint with the supervisor. I was questioned over and over about the incident repeating the same story over and over.

I told the supervisors that I was kicked in the groin area and had the marks to prove it, and that they were heel marks that would surely match the shoes issued to one of his officers. The supervisor made me remove my jumpsuit so a nurse could examine the bruise I had.

I signed a statement that said "internal affairs" and went back to my holding cell.

During this time, I had made bail, but for some reason, I was not being released. I called my parents over and over to confirm my pending release.

Finally, my mother flew down from northern California and talked to the head sheriff and I was released.

When I got home, I immediately took pictures of my right leg which by then had a heel sized black and blue bruise. I called internal affairs to reopen the case that was closed when they agreed to release me.

I then found a lawyer and showed them the pictures and they took the case.

I attended the internal affairs investigation and felt like I was the one accused of wrong doing... they showed me all 3 officers sworn statement saying no beating took place.

Meanwhile my lawyers saw the statement too, and told me frankly based on the officer's statements and the fact I had no witness, the case would prove problematic.

Then one of my lawyers noticed that I was released on bail in the first 24 hours, but not actually released for 48 more hours. All the bail records are time and date stamped and very hard to forge.

My release was held up on the authority of the supervisor I had complained to with the notation "Inmate requires medical treatment". It's true, I had been taken to the nurse 2 times, one when I was booked and a second time after I was complaining I was beaten.

Problem for the officers was that on the first examination I had no marks on me and on the second one I had a large welt on my groin area.

On top of that, I was ordered released by the judge after making bail and the supervisor had no reason to hold me once bail was granted.

The story ends with me receiving a $5000 settlement from the LA county jail. Not for the beating, which my lawyers told me would be a 50/50 proposition, but on the false imprisonment for which the county could give no explanation for.

PATRIOT ACT - A TRUE STORY

THE REALITY OF THE PATRIOT ACT
A TRUE STORY

The following story came to me from a very close friend of mine. Let me tell you a little bit about Mike.

Mike Kimberling is the example of what a human being should strive to be. He is an upright, honest, hard working family man. You would be hard pressed to find a better person than Mike. Mike is a Christian in the ways that Jesus intended for us to be. He is not like so many Faux Christians that dwell in our churches today.

Here is his story…

June 2nd, ‘08

Tommy,

Here’s the scoop again in writing.

I went to visit a man who does some work for me b/c his cell phone was dead and I wanted to see how much progress he made on the job he currently had underway for me. I was inside his apartment talking with him when we heard some commotion outside and went into the parking lot of his complex to investigate. There were two things going on outside.

One was a wreck involving a motorcycle driven by a drunk man and an SUV driven by his female companion. Also up the street some, the police were outside of a house talking with the people there. The police were there for sometime. At some point, someone yelled some obscenities at the police, “Fuck You Pig!”. By this time, several people were in the parking lot of the apartment complex. After a few minutes the police arrived in the parking lot of my friend’s apartment complex. I was standing in the doorway of my friend’s apartment at the time of their arrival.

Everyone in the parking lot, my friend included, disappeared into various apartments. I was the only one who didn’t close the door and hide. I didn’t have any reason to. I remained in the doorway and was approached by a police officer who asked about the obscenities that were yelled. I explained the events as I observed them. He then ordered me to step into the parking lot. I declined and said I’d prefer to stay in the doorway and talk with him. I felt like he was attempting to implicate me in the situation and felt like I’d be safer within the apartment.

At that point another officer arrived on the scene and upon seeing him, the first officer moved past me into the apartment and I followed him inside. I said something to the effect of, “Sir, you don’t have permission to enter these premises nor do you have a search warrant.” He said smugly “You ever heard of 911?”, “Well” he continued, “since 911 there is a new law in effect called the Patriot Act and things have changed.” His partner had entered the apartment as well by this point and ordered me to sit on the couch. I did, and then he asked if anyone else was home. I knew my friend was not, he had been in the parking lot but upon the police arriving he entered another apartment and closed the door just like everyone else except me.

At any rate, I told the police that I wasn’t sure if anyone else was home. I knew there was another man who sometimes slept in the second bedroom. Its door had been closed since I arrived and I never checked to see if he was there or not. While the second officer on the scene was questioning me, the first officer searched the entire apartment. He entered every room including the second bedroom whose door was closed and searched using a flashlight. He returned to the living room where I was seated. I said, “This is totally illegal. You guys can’t do this!” They insisted they could and left the apartment closing the door behind them.

I opened the door and stood there in amazement at what had just happened. The officers remained in the parking lot for sometime talking with another person they found in the parking lot. I waited several minutes for them to finish their conversation and finally, tired of waiting, I said from the apartment doorway, “Excuse me”. Both officers quickly returned to the doorway and asked what I wanted. I asked for a copy of the incident report and looked at both their name badges. The first officer on the scene smugly sounded out his name for me, seeing that I had taken notice of his name badge.

He said he had no intentions of documenting the occurrence. I asked him to. He said he would not but then got on the radio and called for his sergeant. After some coded police chatter via the radio, he informed me that his sergeant was on the way. When the sergeant arrived the officers approached him, had a brief conversation outside my hearing and then all three met me in the doorway.

The sergeant asked me what he could do for me. I explained that I felt like the officer’s actions were unlawful. The sergeant assured me that they weren’t. He explained issues of officer safety and new search provisions of the Patriot Act. He suggested that if I didn’t agree with their actions, my only recourse was to write my congressman.

Upon that, they left. No arrests were made on that scene. No report was ever filed.

Thanks,
Mike Kimberling

Mike got off lucky. Very lucky! Under the “laws” of the Patriot Act those cops could have legally thrown him in jail. Mike would have had no legal recourse. He would not have been allowed to see a lawyer nor would he have been allowed to see his family. If for some reason he made those bulls mad they could have, listen up here, tortured him and shipped him off to Gitmo!

"In the beginning of change, the patriot is a scarce man,
and brave, and hated and scorned. When his cause succeeds,
the timid join him, for it then costs nothing to be a patriot."

Citizen Cops

What was it? Was it just the 9 11? Was it the Patriot Act. This act changed human behavior in untold and unprecedented ways forever, or at least the new version of the McCarthy era, only worse because of high tech, because of our ability to spy on civilians. Now everyone is a policeman, an authority figure. Yes I posted about police brutality, yet we have cop bankers, cop grocery baggers, cop by standers. A grocery boy ordered me to park closer to the market so he wouldn't have to take the cart as far. I offered him a ride to Indian Lake, 30 miles from Orlando, but inside the trunk of my car, and leave him out there to walk back. Then I chewed the manager out in front of customers on the receiving floor.

Yes, you too must fight back! Stop being lulled into polite compliance to those who have ego problems to begin with, and now are intoxicated with their mythical power legends they see on the movies, and wanna be actors pushing a broom. Certainly we don't violate civil, lawful, and descent standards of behavior, but smarting off to them, insults, resistance is something we can make a national movement.

Let's start forming ways and elaborate. Perhaps I can write the book, "How to bust, and arrest a citizen cop." Or the 10 steps to belittle a big government extremist. Plan? Let's come up with it.

Elzier Laurent St. Germaine,

Elzier Laurent St. Germaine, from Montreal QC, US Citizen for over 35 years, served in the US Army for almost ten years. Living at Cebu Philippines, married and will return next year to Las Cruces, New Mexico. I've always been a Libertarian and never even knew it. I was born this way.

A traffic policeman did a search on me for running a red light on a motor scooter. I was wearing a jacket and this was in the day when cell phones were bulky, sort of like a piece of heat-weapn. He threw me on the pavement, shoved his knees between my shoulder blades, arrested me without charge, then found the cell phone he was looking for. I took his ticket and filed a criminal complaint. This was in Minneapolis MN.

Public servants, bankers, physicians are in the post 9 11 style of playing cop. They are watching those high tech anti terrorist movies and wannabee one. Bush and his infantile Patriot Act has caused us all to play ruthless cowboy.

Be careful

The guilty parties in the story you told are the officers who hurt you and any others who knew about it, but not "COPS". There are good and there are bad. There are certain situations you can find yourself in where you wish a cop was around.

It's becoming more and more insane by the day... the question is, what are they preparing for?

Hells bells.

They're going for the Endgame.

But...

Many are still armed and are damn good shots. If the end is in sight it is better to go on your feet than on your knees.

I agree

I heard that statement also. You see that movie "Kingdom?" I heard it there. I wonder when the day we will come up with a descent action movie about modern Liberty and put it out there for America to be inspired with? We need activist actors.

I truly believe if Lennon was alive today, he'd be making protest songs by the hundreds. Now is a good time for the old 60's style hippies with a modern look, protesting this big criminal government. I can see Edgar Hoover, Senator McCarthy rolling in their graves if we do.

Yup. We need a movie!!!

Cops Suck

Even if the story is not real you will find no fan of the police here. I have never had a good expereince with them and I have had only cursory contact. Something is wrong with someone who enjoys lording over people. Get these fat headed jackasses alone and they lose 100% of their Billy bad ass toughness.

I swear on a stack of copies of Atlas Shrugged

This is an absolutely accurate account.

I definitely believe you, also

I worked in Circuit court until 2001, when I resigned to care for my daughter after we were involved in a very bad car accident. I heard the "other side" of what happened during the times suspects/prisoners were being harassed and abused. It is sickening that anyone would be proud of harming another person while he/she was unable to defend him/herself. The court system I worked in had very few of these types, but one was too many. And the worst thing was that many times even those good/honest (for the most part, considering they tolerated those things) LEO's covered up for the criminals among them.

I believe you

I have been harassed by the police and I have seen them harass other people. You have nothing to prove to me. People are blind to the fact that many of these guys are on an out of control ego trip. It is what they are taught and how they are taught. They believe they are above the average citizen. Good luck to any of you if you rely on them to help you. Ask John Ramsey how much they helped.
