Kop Busters

It's called an informant plant. The Odessa narcotics unit illegally compelled an informant to plant drugs on Yolanda Madden. The informant testified in federal court he planted the drugs on her and he passed a polygraph confirming the same. Yolanda also passed a polygraph along with a hair follicle and urine test. Our broken criminal justice system ignored the evidence and railroaded her through court sentencing her to 8 years in prison.

Her father hired KopBusters, a new reality show produced by NeverGetBusted, whereby Barry and Candi along with their detectives set up stings across America to catch crooked Kops.

KopBusters rented a house in Odessa, Texas and began growing two small Christmas trees under a grow light similar to those used for growing marijuana. When faced with a suspected marijuana grow, the police usually use illegal FLIR cameras and/or lie on the search warrant affidavit claiming they have probable cause to raid the house. Instead of conducting a proper investigation which usually leads to no probable cause, the Kops lie on the affidavit claiming a confidential informant saw the plants and/or the police could smell marijuana coming from the suspected house.

The trap was set and less than 24 hours later, the Odessa narcotics unit raided the house only to find KopBuster's attorney waiting under a system of complex gadgetry and spy cameras that streamed online to the KopBuster's secret mobile office nearby.

The attorney was handcuffed and later released when eleven KopBuster detectives arrived with the media in tow to question the illegal raid. The police refused to give KopBusters the search warrant affidavit which is suspected to contain the lies regarding the probable cause.

The team of eleven freedom fighters wore red "Free Yolanda" shirts as they clashed with the police demanding answers for the illegal raid and the drug plant. The police would not comment but later stated they were trying to charge KopBusters with a crime.

It is not illegal to grow plants under a light in your home but it is illegal to lie on an affidavit and plant drugs on a citizen. This operation was the first of its kind in the history of America. Police sometimes have other police investigating their crimes but the American court system has never dealt with a group of citizens stinging the police. Will the police file charges on the team who took down the corrupt cops? We will keep you posted.

Awesome

This is awesome! Too bad their site's been taken down. Either they didn't pay their bills, or someone is trying to close up their shop.

Befehl ist Befehl

"The Nuremberg Defense is a legal defense that essentially states that the defendant was 'only following orders' ('Befehl ist Befehl', literally 'order is order') and is therefore not responsible for his crimes. The defense was most famously employed during the Nuremberg Trials, after which it is named."

http://en.wikipedia.org/wiki/Whistle_blower#Legal_protection_for_whistle...
"Ideas about whistleblowing vary widely. Whistleblowers are commonly seen as selfless martyrs for public interest and organizational accountability; others view them as 'dobbers' or 'snitches' (slang), solely pursuing personal glory and fame. Because the majority of cases are very low-profile and receive little or no media attention and because whistleblowers who do report significant misconduct are usually put in some form of danger or persecution, the latter view is generally less held."

Wikipedia is the last place anyone should look for information, matter of fact, don't go there. IMO anyone who quotes from Wikipedia has made a MISTAKE, and that's ok, I make mistake also. Tom

How the cops get away with it

"When faced with a suspected marijuana grow, the police usually use illegal FLIR cameras and/or lie on the search warrant affidavit claiming they have probable cause to raid the house."

The most common method of falsifying an affidavit for search warrant (in some jurisdictions called a complaint for search warrant) is to make up a fictitious informant 'John Doe' and the narrative usually goes like this:

I, P.O. Joe Blow, Star/Badge No *******, hereby attests to the following facts which I believe establish probable cause for a search warrant to search (insert person or house or location)...

"On today's date, the above referenced police officer had a conversation with a John Doe (name withheld for fear of reprisal) who has been cooperating successfully with the department for several years and who provided this officer with the following information. John Doe is and has been a cannabis user for the last 7 years. John Doe is familiar with the purchase, sale, pricing and consumption of cannabis.

"Yesterday, (date) John Doe was at (address you want to search) and while inside personally observed what John Doe knew to be two cannabis plants growing in a room on the first floor off the n/west corner of the white two-story home. John Doe stated that while inside, he had a conversation with the owner of the home, who confirmed to him that the plants indeed were a particularly potent strain of cannabis. John Doe also related to me that he was then offered a cannabis "joint"(cannabis cigarette commonly used to ingest cannabis smoke) and John Doe smoked the joint and felt the same euphoric high that John Doe felt when previously smoking cannabis. John Doe then left the premises with an offer from the owner of the premises to return anytime, presumably to smoke and/or purchase cannabis in the future. I drove the John Doe by the address in question on today's date and John Doe pointed out to this officer the exact address and approximately where in the home the plants could be found growing."

Based on the foregoing, P.O. (name) believes that illegal cannabis is currently being manufactured at the above listed address and that cannabis, cannabis growing paraphernalia, dried cannabis and illegal drug proceeds (United States Currency), receipts and other items commonly associated with drug sale/use may be found."

The reason for the use of the John Doe is not coincidental. Its tactical. The affiant in this type of affidavit is the police officer himself. The officer relates the made up story of what John Doe told him (since john doe doesn't exist). Thus, all the "lies" that are submitted to the court are done so through the proxy - John Doe. Anyone caught lying on an affidavit for search warrant is committing perjury. So how do they not get caught?

First: If the police are just wrong on their suspicion and no drugs are found, no criminal charges are instituted, there is no criminal case and the search warrant rarely, if ever, comes up again.

Second: If drugs are found, 9 times outta 10 the person will just cop out/plea and not challenge the warrant process even if they know the informant's tale is BS when they are presented with a copy of the warrant during their criminal proceeding. This is a sad reality, but its true, and the cops know it as well as anybody.

Third: Even if the person hires a good defense attorney and that attorney files a motion to quash the search warrant and seeks to challenge the John Doe's information: The defense attorney is prevented from calling the John Doe or even learning his/her name at the hearing to protect the secret identity and physical well-being of police informants (with one limited exception, the Franks hearing, that I wont go into detail now.) The defense is allowed to call the affiant to the warrant - (the officer) - but it isn't the officers information that makes up the lies. Hearsay is allowed in support of a search warrant, so the officer can testify all he wants about what John Doe told him without ever having to worry bout the non-existent John Doe actually being called to testify. Once the drugs are admitted into evidence (not suppressed) john doe is no longer needed for trial purposes, you just need to show a connection between the drugs and the defendant to convict (which you will always have if the drugs are found in the defendant's home.)

In other words, if an officer lies and makes up an informant - the chances of getting caught are very very slim. It is in reality, from the cops perspective - little risk and big reward. So it happens. All the time.

Barry Cooper understands all this quite well. What he is doing is rather heroic. And very risky. I expect blowback from the government - possibly his show getting forced off the "air" - if he is even mildly successful.

Outstanding Work!

I know of no barrier to citizens operating in a lawful manner to uncover unlawful conduct, regardless of who the target(s) may be. Perhaps they should present their findings to the Grand Jury in their jurisdiction?
