Who you are, where you travel could make you FBI target. The Justice Department is considering letting the FBI investigate Americans without any evidence of wrongdoing, relying instead on a terrorist profile.

Currently, FBI agents need reasons -- such as evidence or allegations that a law probably has been violated -- to investigate citizens and legal residents. The new policy, law enforcement officials say, would let agents open terrorism investigations after mining public records and intelligence to build a profile of traits that, taken together, are deemed suspicious.

14th Amendment

David Rivkin claims no Constitutional rights are being violated, and technically he's correct: the information being gathered would be publicly available, and the 14th Amendment only requires -states- to provide Equal Protection under the Law. But I think the exclusion of the federal government from the Equal Protection Clause was a major oversight, probably due to the fact that at the time it was passed, the fedgov wasn't a problem in this area. Of course, the terrorism bogeyman trumps civil rights in the current administration's mind, so it isn't a problem to them now.

Where does it stop?

The echoes to what happened in Germany with the Jews and what happened even here in the US with the internment camps of the Japanese are almost too much to take. how can the man on the phone sit there with a straight face and tell the reporter that no civil liberties will be violated is beyond me when he knows full well that there is no guarantee that what he's saying is correct.
